These Terms of Use ("Terms") govern your use of the NearUNow mobile application and website (nearunow.ie), operated by HiSpeed Wireless Broadband Ltd, Unit 25, Waterford Business Park, Cork Road, Waterford, Ireland ("NearUNow", "we", "us", or "our").
NearUNow is a trading name of HiSpeed Wireless Broadband Ltd, registered at Unit 25, Waterford Business Park, Cork Road, Waterford, Ireland.
By downloading, installing, or using NearUNow, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. About NearUNow
NearUNow is a local appointment marketplace. It works in both directions.
- Businesses post real openings — a cancellation, a spare hour, an appointment later this week.
- Customers see what is genuinely available nearby and can request an appointment.
- If nothing suitable is listed, a customer can post what they need, and businesses nearby can respond.
NearUNow does not confirm appointments. When you request one it is requested, not booked. It stays that way until the business itself confirms or declines it. Nothing in NearUNow accepts an appointment on a business’s behalf, and a request is not an agreement until the business says so.
You can also call or message a business directly where it has published a number. NearUNow is not a party to any arrangement you make with a business, however you make it.
NearUNow is currently free to use. We reserve the right to introduce pricing in the future, and will give reasonable notice to registered users before doing so. Taxes may apply based on your location.
2. Eligibility
You must be at least 18 to register a business on NearUNow. By registering you confirm you are 18 or over and have authority to bind yourself or your business to these Terms.
You must also be 18 or over to post or respond to a modelling request. Customers can browse NearUNow without an account. To request an appointment you give a name and phone number so the business can reply to you — see our Privacy Policy for what happens to that.
3. User Responsibilities
3.1 All Users
- You must use NearUNow for lawful purposes only.
- You must not attempt to reverse-engineer, hack, scrape, or disrupt the NearUNow service.
- You must not use NearUNow to harass, defraud, or harm any other user or business.
- You must not impersonate any person or entity.
- You are responsible for maintaining the security of any device you use to access NearUNow.
3.2 Business Users
- You are responsible for the accuracy of all information you provide, including your business name, phone number, service categories, location, prices and the openings you post.
- You must ensure your listed phone number is correct and active, and that you monitor NearUNow for incoming requests while you have openings posted.
- You must respond to appointment requests within a reasonable time, and you must honour any appointment you have confirmed, whether it was arranged through a request in the app or by a call.
- You must not post openings for services that are illegal or prohibited under Irish law.
- You must not post fictitious openings, and you must not use NearUNow as a general advertising platform unrelated to genuine availability.
- You are responsible for all activity that occurs under your account. You must keep your login credentials secure and notify us immediately of any unauthorised use.
4. Rules for Posting Openings
Every opening you post on NearUNow must:
- Represent a genuine, available appointment time at your business.
- Be for a lawful service that you are qualified and licensed to provide.
- Display an accurate business name and phone number.
- Be in the correct service category.
- Be at your genuine business location. You may choose to keep your exact address private and show only your area, but the location you give us must be real.
The following are prohibited:
- Posting openings for appointments that do not exist or cannot be honoured.
- Listing services you are not authorised or qualified to provide.
- Using NearUNow to promote products, events, or services unrelated to appointment-based bookings.
- Creating multiple accounts for the same business to gain visibility.
- Posting misleading, discriminatory, or offensive content in any field.
We reserve the right to remove any listing and suspend or terminate any account that violates these rules, at our sole discretion and without prior notice.
5. Requests, Confirmations and Payments
How a request works. A customer taps to request an appointment on an opening a business has posted. The business receives the request and either confirms it or declines it. Until it is confirmed, nothing is booked. NearUNow never confirms on a business’s behalf and never guarantees that a request will be accepted.
Posting what you need. A customer can post the service and timeframe they are looking for. Businesses nearby can see it and offer a suitable time. A post is not an appointment, and an offer is not an appointment until it is confirmed.
Payments. NearUNow does not process, handle or hold any payment or deposit. You pay the business directly, exactly as you would otherwise. A business can display which payment methods it accepts — that is information only, and no card or bank details pass through NearUNow.
NearUNow is not a party to any appointment. The service itself, its quality, its price, any cancellation and any refund are matters between the customer and the business.
6. Contacting a Business
Where a business has published a phone number you can call it, or message it on WhatsApp, from within NearUNow. Doing so opens your device’s own phone or messaging app. NearUNow has no involvement in and accepts no responsibility for what is said or agreed in that conversation.
Business addresses. A business may choose to keep its exact address private. In that case NearUNow shows only its area publicly, and the exact address is released to a customer only after that business has confirmed their appointment.
7. Intellectual Property
All intellectual property rights in the NearUNow app, website, and content (including design, branding, and underlying code) are owned by HiSpeed Wireless Broadband Ltd or our licensors. You are granted a limited, non-exclusive, non-transferable licence to use NearUNow for its intended purpose.
By posting content to NearUNow (such as a business name, description, or category), you grant us a non-exclusive, royalty-free licence to display that content within the NearUNow platform.
8. Availability and Service
We aim to keep NearUNow available 24/7 but we do not guarantee uninterrupted access. We may suspend or modify the service at any time for maintenance, updates, or other operational reasons, without notice or liability.
9. Limitation of Liability
To the fullest extent permitted by Irish and EU law:
- NearUNow is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
- We are not liable for any loss or damage arising from your use of, or inability to use, NearUNow.
- We are not liable for any disputes, cancellations, declines, no-shows or other issues arising between customers and businesses — whether they follow an appointment request, a posted need, a business response, or a call or message made through NearUNow.
- We are not liable for the accuracy of anything a business publishes, including its phone number, location, prices, accepted payment methods or the availability of an opening.
- We are not liable for any indirect, consequential, special, incidental, or punitive damages howsoever arising.
- Our total aggregate liability to you for any claim shall not exceed €100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish law.
10. Indemnity
You agree to indemnify and hold harmless HiSpeed Wireless Broadband Ltd and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of NearUNow, your breach of these Terms, or any content you post on the platform.
11. Termination
We reserve the right to suspend or terminate your account and access to NearUNow at any time, with or without cause, and without prior notice. You may also delete your account at any time through the app or by contacting us at info@nearunow.ie.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
If you are a consumer in the EU, you may also have the right to refer a dispute to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to These Terms
We may update these Terms from time to time. Business users will be notified of material changes via email or an in-app notification. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of NearUNow after changes constitutes acceptance of the updated Terms.
